How many people have joined the suit so far?
As of today more
than 1,000 current and
former workers
have joined the lawsuit with over half of these coming from Rochester and Syracuse
facilities.
How Did Sutherland Not Pay Overtime Correctly?
The law requires that employees be paid for all time
they are permitted to work. Our
investigation has shown that Sutherland failed to
pay proper overtime for the hours they permitted
employees to work through a variety of means,
including the following:

Making automatic time deductions for lunch
breaks even when employees worked through all or
part of their lunch.

Failing to pay employees for time spent
performing work duties before the start of their
regularly scheduled shift; and
-
Improperly failing to include commissions and
bonuses in calculating pay for overtime
purposes.
The law requires that hourly employees receive time
and a half for all hours they work over forty
in a week.
Do I Have Any Deadlines I Need To Worry About, Or

If your consent form was
not received by September 1, 2007 you are NOT
eligible for the Federal portion of the lawsuit.
However, your rights under New York, California and
Virginia law may still be protected. You will
receive a notification from the court at a later
date if you are eligible for a claim in any of these
states.

Our primary goals in this collective action are to:
